COMMON PRAYER : Writ Petitions filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus, directing the third to fifth respondents to reimburse a sum of Rs.1,16,000/- in A/c.No.G-01484, Rs.1,04,000/- in A/c.No.G-01428 and Rs.48,500/- in A/c.No.G-01494, which were deposited on the file of the fifth respondentBank at Velayuthapuram Branch, Kovilpatti, Thoothukudi District, to the respective petitioners.

the learned Government Advocate (Criminal Side), takes notice for the first and fourth respondents.

After hearing the learned Special Government Pleader for the second, third and fifth respondents and the learned Government Advocate (Criminal Side) for the first and fourth respondents and after dispensing with the notice to the private respondent, i.e., the sixth respondent herein, as no adverse is proposed to be passed against him, this Writ Petition is being disposed of at the time of admission itself.

3. The petitioners appear to have deposited sums of Rs.1,16,000/-, Rs.1,04,000/-, and Rs.48,500/- respectively with the fifth respondentBank. It appears that the sixth respondent has embezzled the amounts, as a result of which the deposited amount has not been refunded back to the petitioners. It is the case of the petitioners that, under similar circumstances, directions have been issued by this Court to refund back the deposited amounts within a period of 12 weeks. In this connection, a reference is made to the decisions of this Court dated 24.08.2023 passed in W.P.(MD) Nos.18801 to 18803 of 2023, and dated 19.02.2025 passed in W.P.(MD) Nos.9638 to 9640 of 2024.

4. In view of the orders passed by this Court in the two aforementioned cases, there shall be a direction to the third to fifth respondents to refund the amounts back to the petitioners within a period of 12 weeks from the date of receipt of a copy of this order.
