ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 143, 353, 341 of I.P.c. and Section 3(1) of TNPPDL Act, in crime No.136 of 2018, seeks anticipatory bail.

2.The case of the prosecution is that when the defacto complainant indulged in acquisition and measures the land for establishing a bus stand at Agni Theertham sea shore in pursuance of the Swethesh Dharsan Scheme, the petitioner and others said to have restrained the defacto complainant from carrying their works and they incurred a sum of Rs.9,000/- loss in account of the salary to the labours. Hence, the complaint.

3.Heard the learned counsel appearing for the petitioners. 4.The learned Government Advocate (criminal side) submitted that this is the second application filed by the petitioner and earlier, the petitioner and another filed Crl.O.P.(MD) No.14108 of 2018,wherein, this Court dismissed the petition as against the petitioner and granted as against the another person. Therefore, there is no change of circumstance and hence, he opposed the anticipatory bail.

5.Taking note of the facts and circumstances, since there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner .

6.Accordingly, this criminal original petition is dismissed. The respondent police directed to arrest the petitioner and produce before the Court concerned.
