The petitioner/defacto complainant in Crime No.180 of 2022 has approached this Court that the respondent police has not filed the final report in the above crime number.
2.Mr.P.Kottaichamy, learned Government Advocate (Crl.side) takes notice for the respondents and submits that the investigation in Crime No.180 of 2022 has been completed and they found that no case is made out and therefore, they are going to refer the case as ''mistake of fact'' and they require some time to serve RCS notice to the petitioner.
3.Recording the submission made by the learned Government Advocate (Crl.side) that the respondent police has completed the investigation and they are about to close the case in Crime No.180 of 2022 as mistake of fact, this Criminal Original Petition is closed with a direction to the respondent to serve the RCS notice along with the final report to the petitioner, within a period of one week from the date of receipt of a copy of this order. It is open to the petitioner to file his objection petition, if any before the concerned Magistrate and the 2/4
learned Magistrate shall entertain the same, provided, if the petition is filed within a period of two weeks from the date of receipt of a copy of the RCS notice.
