This Criminal Original Petition has been filed to call for the records pertaining to the proceedings in C.C.No.270 of 2021 on the file of the learned Judicial Magistrate No.III, Nagercoil, Kanniyakumari District in Crime No.294 of 2019 on the file of the 1st respondent Police and quash the same.

Even though this Criminal Original Petition has been filed for a larger relief, today, when the matter was taken up for hearing, the learned counsel appearing for the petitioner restricted his prayer to dispense with the personal appearance of the petitioner before the trial Court and seeks early disposal of the proceeding in C.C.No.270 of 2021 pending on the file of the learned Judicial Magistrate No.III, Nagercoil,

Taking into consideration of the request as made by the learned counsel for the petitioner, the appearance of the petitioner before the trial court is dispensed with except for his appearance for the purpose of receiving the copy of the proceedings u/s 207 Cr.P.C., framing of charges, questioning under Section 313 Cr.P.C. and on the day on which 2/4

judgment is to be pronounced. However, if for any particular reason, the presence of the petitioner is necessary, the trial court, at its wisdom, shall direct those appearance on those days. The learned Judicial Magistrate No.III, Nagercoil, Kanniyakumari District is directed to dispose of the case in C.C.No.270 of 2021 pending on his file as expeditiously as possible.

4. With the above direction, this Criminal Original Petition is disposed of. Consequently, the connected Miscellaneous Petitions are closed.
