Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents to constitute an Expert Committee to supervise the rural road works in Kanyakumari District to ensure the execution of the works as per the estimates, after milling/scrapping the existing roads and also to check and verify the measurements and quality of the roads after completion of the work, before settling the bills for the same.

O R D E R

[Order of the Court was made by S.M.SUBRAMANIAM, J.] This writ petition is filed seeking issuance of a Writ of Mandamus to direct the respondents to constitute an Expert Committee to supervise the rural road works in Kanyakumari District to ensure the execution of the works as per the estimates, after milling/scraping the existing roads, and also to check and verify the measurements and quality of the roads after completion of the work, before settling the bills for the same.

2. The relief sought for in the present writ petition is misconceived. The court need not constitute the Expert Committee to supervise the rural road works in Kanyakumari District, since it is the duty of the department concerned to execute the work and maintain the same properly in consonance with the statutes and rules.
