ORDER

This petition has been filed seeking to direct the respondents to grant permission to the organizers of the Maha Kumbabisekam to the Arulmigu Balathandayuthabani Sri Subramaniar Temple Thokkanenthal Village Ilayangudi Taluk, Sivagangai District on 11.9.2018 for conducting Dance and entertainment programs.

2.The learned Government Advocate would submit that the permission cannot be granted to the petitioner to conduct the Kumbabisekam on 11.09.2018 since 144 order has been issued by the District Collector, for the entire Sivagangai District on 11.09.2018.

3.The learned counsel for the petitioner would submit that on 11.09.2018 the petitioner will not go ahead and the festival will be conducted only on 12.09.2018.

4.The learned Government Advocate would submit that if the Kumbabisekam is to be conducted on 12.09.2018, the respondent police will be able to provide permission and necessary police protection to the petitioner.

5. Taking into consideration of the facts and circumstances of the case, this Court is inclined to direct the second respondent to grant permission and adequate police protection to celebrate the festival of Kumbabisekam on 12.9.2018 at Arulmigu Balathandayuthabani Sri Subramaniar Temple Thokkanenthal Village Ilayangudi Taluk, Sivagangai District.

6.It is made clear that the respondent police is at liberty to impose any conditions to ensure the peaceful conduct of the festival and the petitioner is bound to comply with the same. 7.The Writ Petition is disposed of with the above direction. No costs.
