This Writ Petitioner had given a representation complaining that pending Civil Revision Petition in C.R.P.(MD)No.535 of 2006 before this Court, wherein the respondents 2 to 9 are the parties, the 8th respondent has sold the property to the 9th respondent. The 9th respondent had mortgaged the property with the 10th respondent bank. In view of that, a representation had been given by the petitioner seeking necessary action to be taken owning to such transaction. But this is the relief sought for by the petitioner in C.R.P(MD)No.535 of 2006, which is pending before this Court. The petitioner cannot maintain two parallel proceedings. If there is an efficacious remedy available and the same is pending, the petitioner cannot be permitted to seek mandamus for the same cause only because a representation has been given.
