ORDER

Challenging the impugned notice issued by the third respondent in Proc.No.797/B/03, dated 27.06.2019, this writ petition has been filed by the petitioner.

It is the case of the petitioner that he has been running a business called M.A.K.Oil Mills and he was an allottee of a plot by the first respondent in Pudukkottai District in the year 2003, on a monthly rental basis of Rs.5,000/-. The petitioner claimed to have been paying the rent regularly. Thereafter, due to the set back in his business, he was unable to pay the rent. Hence, the respondents issued notice calling upon the petitioner to pay the arrears of rent, in which, they have also mentioned in proceedings dated 28.11.2013 that they have cancelled the allotment order. Pursuant to the said cancellation order, the second respondent has sent an eviction notice to the petitioner. At that juncture, the petitioner seems to have undertaken to pay the arrears of rent amount. Thereafter, by demand draft on 20.03.2014 the petitioner had paid the arrears to the extent of Rs.6,64,500/-.

Thereafter also, the petitioner has failed to pay rent and eviction notice dated 06.02.2016 was issued and the same was challenged by the petitioner in W.P(MD).No.3573 of 2016, wherein an order of interim stay was granted on condition that the petitioner shall pay the arrears of rent on two instalments and pay the future rent continuously without fail. The said writ petition subsequently had been withdrawn by the petitioner.

Once again, the petitioner became a defaulter and hence, the respondent passed the eviction notice dated 27.06.2019 calling upon the petitioner to vacate and handover the possession, otherwise the petitioner will be evicted from the property on 17.07.2019 at 11.30 am. Challenging the said eviction order, the present writ petition has been filed.

5. When the matter came up for hearing on 16.07.2019, this Court granted an order of status quo subject to condition that the amount stipulated therein be paid. Thereafter, since the petitioner has failed to comply with the conditional order, status quo granted by this Court ceased to operate with immediate effect, on 26.08.2019.

Today, the matter came up for hearing, it is brought to the notice of this Court that subsequent eviction order has been passed on 06.08.2021 directing the petitioner to vacate and hand over the possession and the same was challenged by the petitioner in W.P(MD).No.15042 of 2021, wherein reference is made to this instant writ petition. The said writ petition was dismissed, against which, writ appeal has been filed in W.A(MD).No.1802 of 2021 before this Court and the same was also dismissed vide order dated 23.09.2021.

7. In view of the subsequent developments, this Writ Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
