ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents to issue death certificate for the petitioner's deceased cousin, namely, R.Gurusamy.
2. It is seen that the said R.Gurusamy died in the year 2023. Since more than one year has lapsed, the respondents have refused to consider the issuance of the death certificate. Such a refusal is against law. Even though the application was submitted belatedly, the respondents are bound to take up the issue, consider it and pass appropriate orders. In a similar case in W.P.No.7978 of 2025 dated 07.03.2025, this Court directed the respondent to issue the death certificate with certain conditions.
3. The petitioner has already submitted the application, but some of the documents are not furnished. Therefore, the petitioner is directed to submit all necessary documents to the respondents within a period of two (2) weeks from the date of receipt of a copy of this order. If necessary, the petitioner is directed to 2/4
file an undertaking affidavit stating that there is no rival claim. Thereafter, the respondents shall consider the application and pass orders in accordance with law, within a period of six (6) weeks therefrom.
4. With the above said direction, this Writ Petition is allowed. There shall be no order as to costs.
