O R D E R

The learned counsel for the petitioner restricted the prayer in this writ petition by contending that the petitioner has already submitted his explanation to the impugned charge memo and Enquiry Officer has also been appointed in the departmental disciplinary proceedings. Therefore, the petitioner may be permitted to peruse all the relevant records for the purpose of defending his case in the enquiry proceedings.

2. It is needless to state that the delinquent official is entitled to peruse the records, which are all relied upon by the Department for the purpose of establishing the charges. Therefore, the respondent is directed to permit the petitioner to peruse the records for the purpose of defending his case during the course of enquiry. The petitioner is also directed to cooperate for the enquiry for early disposal of the same.

3. This being the factum, the respondent is directed to conclude the enquiry proceedings as expeditiously as possible, by following the procedures as contemplated in the Service Rules and by affording due opportunity to the petitioner to peruse the records to defend his case.

4. With these observations and directions, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
