ORDER

This Writ Petition has been filed for a direction to the respondents to grant permission and adequate police protection for conducting the Vinayagar Saturthi festival and holding procession as per the petition given to the respondents dated 04.09.2018.

The learned counsel appearing for the petitioner would submit that the festival is being conducted during the month of Aavani every year and this year, it has been decided to conduct the Vinayagar Saturthi festival by placing Lord Vinayagar idols at the places i.e.,from K.R.R.Kalaiarangam to Vinayagar River to be held on 23.09.2018 at Kodaikanal, Dindigul District. The petitioner has given a representation dated 04.09.2018 to the respondents seeking for permission and the same has not been considered till date. Therefore, the present writ petition has been filed.

3.The learned counsel for the petitioner sought for permission to have the procession on 23.09.2018. In the meeting conducted before the Revenue Divisional Officer, Dindigul District, it was agreed to grant permission only between 13.09.2018 and 17.09.2018. 4.The learned Government Advocate would Submit that already other organisation has been allowed to conduct festival on 16.09.2018 and the petitioner can conduct the festival in any of the dates from 13.09.2018 to 15.09.2018 and on 17.09.2018 permission will be granted to the petitioner. 5.

Taking into consideration of the facts and circumstances of the case, this Court is inclined to direct the third respondent to grant permission and adequate police protection to celebrate the "Vinayagar Chathurthi Thiruvizha" on any of the above mentioned dates at Puthumanai, Radhapuram, Tirunelveli District. 6.It is made clear that the respondent police is at liberty to impose any conditions to ensure the peaceful conduct of the festival and the petitioner is bound to comply with the same. 7.Accordingly, the writ petition is disposed of with the above directions. No costs.
