For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1 of 2019 on the file of the Respondent Police.

ORDER :

The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences under Sections 420, 408, 409, 468, 471, 477 A and 120 B IPC in Crime No.1 of 2019. He seeks anticipatory bail. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondent police. 3.The petitioner was a member of the next level committee that was responsible for verifying the list of beneficiaries who were to be given the benefit of crop loan waiver in Kavadipatti Primary Agricultural Society.

4.The learned counsel for the petitioner submits that even though the petitioner reached the age of superannuation, he was not allowed to retire. The petitioner has since been placed under suspension vide order dated 29.07.2019 made in RC No.3456/2019/EM (I). CRL OP(MD). No.10072 of 2019 documentary evidence and that his arrest is not really warranted. However, the petitioner is directed to appear before the respondent police and cooperate with the investigation daily at 10.30 A.M for a period of two weeks and thereafter, he shall appear before the respondent as and when required.

5.Subject to the above said condition, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.I, Ramanathapuram, Ramanathapuram District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and he shall appear before the respondent police as mentioned above.

6.The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed. sd/- 03/09/2019 / TRUE COPY / Sub-Assistant Registrar (C.S.)
