In Both Petitions For Respondent : Mr.M.Chandra Sekaran, Additional Public Prosecutor In Both Petitions PETITIONS FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Bail in Crime Nos.144 & 229 of 2019 on the file of the Respondent Police COMMON ORDER : The Court made the following order : The petitioner is a sole accused in Crime Nos.144 & 229 of 2020 apprehending arrest at the hands of the respondent police for the offences punishable under sections 302, 379 of I.P.C., and 341, 376 and 506(ii) of IPC, respectively; on the file of the respondent police, seeks anticipatory bail.
2. The learned Additional Public Prosecutor made a submission that the petitioner/accused is a habitual sexual offender. He has involved in several cases and at present two cases are pending against the petitioner and both the cases are in connection with sexual offence of rape and murder. He has committed murder for gain also. After committing murder he has stolen the jewels of the deceased. The learned Principal District and Sessions Judge, Ramanathapuram, considered the facts and circumstances declined to grant bail as investigation was in the preliminary stage. https://hcservices.ecourts.gov.in/hcservices/ 1/2

The Court is of the considered opinion that the petitioner being a habitual sexual offender and involved in rape cases and further committed murder and had stolen the jewels, it is not a fit case for grant of bail. This apart, the investigation is in progress and in the event of enlarging the petitioner on bail, there is likelihood of tampering the witnesses and this apart, there is a chance of fleeing away.
4. Considering the facts and circumstances, this Court is of the considered opinion that the Court of Sessions has also rightly rejected the bail and the petitioner has not established any acceptable ground for the purpose of granting bail in the present petition.
