Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents to ensure for using common pathway situated in Government land survey No.220/9 with an extent of 10 x 15 feet at Nellaiyadikadu Village Manakadu Post Peravoorani Taluk Thanjavur District in the meantime the respondents to provide for necessary police protection in life and limb of the petitioner and his family members on the basis of the representation given by the petitioner dated 20.07.2018.

ORDER

This petition has been filed for a direction to the respondent police to give protection to the petitioner and his family members during the marriage of the petitioner's daughter to be held on 12.09.2018.

2.The learned counsel for the petitioner would submit that the Writ Petition has been filed in W.P.(MD)No.17037 of 2017 before this Court for a direction to the official to remove the encroachments that has been made in the common pathway in Survey No.220/9 at https://hcservices.ecourts.gov.in/hcservices/

Nellaiyadikadu Village, Manakadu Post, Thanjavur District. The Writ Petition is still pending. The persons against whom the Writ Petition has been filed cause serious threat to the petitioner and his family and all attempts are made to cause law and order problem during the marriage function that is to be held on 12.09.2018. The petitioner has given a representation dated 20.07.2018 to the respondents.

3.Taking into consideration of the facts and circumstances of the case, the fourth respondent is directed to consider the representation of the petitioner and enquire the same and if necessary, to provide police protection on 12.09.2018 during the wedding of the petitioner's daughter.

4.Accordingly, the writ petition is disposed of with the above directions. No costs. Consequently connected Miscellaneous Petition is closed.
