O R D E R
The Petitioner herein seeks a direction to the third respondent to issue computerised patta to the Petitioner for the land in S.No.420/3 of Sammati Viduthi Village, Pudukkottai Taluk measuring 0.04.5 ares based on the recommendation made in Oo.Mu.A1/3411/2022, dated 31.7.2025.
2.Mr.A.Baskaran, learned Additional Government Pleader takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.It is the case of the Petitioner that the subject property has been in his possession and enjoyment from the days of his father. The Petitioner had constructed a house and residing thereon. Based on his long possession, he submitted an application seeking 2/6
issuance of patta. The same was not considered. Hence the Petitioner filed a Writ Petition before this Court in W.P(MD)No. 4138 of 2020 seeking a direction to consider his representation for issuance of a patta. In the said Writ Petition, the respondents therein had taken a stand that the subject property was classified as 'Anadheenam' and therefore, patta could not be issued to the Petitioner. After recording the stand of the respondents, this Court directed the third respondent herein, who was arrayed as second respondent therein, to consider the request of the Petitioner on its own merits and pass final orders. Pursuant to the direction issued by this Court, third respondent in his proceedings in Oo.Mu.A1/3411/2022, dated 31.7.
2025 informed the Petitioner that steps have been taken to convert the classification of the land from 'Anadheenam' to 'Natham' in order to facilitate issuance of patta to the Petitioner. Though the said communication was sent to the Petitioner as early as on 21.03.2023, till date there is no progress. Therefore, the Petitioner has come forward with the instant Writ Petition for the relief stated supra. 4..Mr.A.
Officer in the light of the recommendation made by the Tahsildar in his proceedings, dated 31.7.2023 referred to above. 5.In view of the above said submission made by the learned Additional Government Pleader appearing for the respondents 1 to 3, the second respondent is directed to consider the request made by the Petitioner for issuance of patta in the light of the proceedings of the third respondent in Oo.Mu.A1/3411/2022, dated 31.7.2025 and pass final orders on its own merits, within a period of 8 weeks from the date of a copy of this order. 6.With the above direction, the Writ Petition stands disposed of. No costs.
