Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus directing the 2nd respondent to grant permission to quarry the remaining 1640 loads of clay sand on the basis of the order passed by the 1st respondent in Na.Ka.KV.3/47340/2013 dated 19.06.2014 by considering the petitioner's representation dated 02.02.2017. ORDER

This Writ Petition has been filed praying for the issuance of a writ of Mandamus directing the second respondent to grant permission to quarry the remaining 1640 loads of clay sand on the basis of the order passed by the first respondent in Na.Ka.KV.3/47340/2013 dated 19.06.2014 by considering the petitioner's representation dated 02.02.2017.

2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. Seeking the afore-said prayer, the petitioner has submitted a representation to the second respondent on 02.02.2017. Since the said representation dated 02.02.2017 did not evoke any response, the petitioner has come forward with this writ petition.

4. The learned Additional Government Pleader on instructions submitted that the representation of the petitioner will be considered in accordance with law.

5. Considering the limited scope of the matter, without adverting into the merits of the case, the second respondent is directed to consider representation of the petitioner, dated 02.02.2017 on merits and in accordance with law and dispose of the same, within a period of two weeks from the date of receipt of a copy of this order. The petitioner is directed to enclose a copy of this order besides the representation, for further follow up, in this regard. No Costs.

6. With the above direction, this Writ Petition is disposed of. No Costs.
