Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the respondents to consider petitioner representation dated 06.01.2017 and also take necessary steps to give the petitioner's Provident Fund and other benefits to him within stipulated time by this Court. O R D E R

********** This Writ petition has been filed for issuance of writ of mandamus directing the respondents to consider petitioner's representation dated 06.01.2017 and also take necessary steps to give Provident Fund and other benefits to the petitioner within a stipulated time.

2.Heard Mr.S.Muthu Kumar, learned counsel appearing for the petitioner and Mr.D.Venkatesh, learned counsel appearing for the respondents.

3.The petitioner joined as Process Server in the Sub Court, Devakottai on 13.06.1962. Based on a charge, the petitioner was terminated from the service on 21.10.1986. The petitioner, who is https://hcservices.ecourts.gov.in/hcservices/

now aged 79 years, would state that the Provident Fund and other benefits were not given to him. Therefore, he submitted a representation to the respondents 1 and 2 based on which the 2nd respondent vide memo dated 21.12.2016 directed the petitioner to produce necessary records from the place where he last functioned. It appears that the petitioner had worked lastly in District Munsif Court, Sattur. Therefore, the petitioner sent a representation to the 3rd respondent on 06.01.2017. Since his representation has not been considered, the petitioner is before this Court.

4. In the light of the limited relief sought for, without going into the merits of the contentions raised by the petitioner with regard to his entitlement for the relief, there will be a direction to the third respondent to consider the representation dated 06.01.2017 and pass appropriate orders on merits and in accordance with law and communicate the same to the petitioner within a period of four weeks from the date of receipt of copy of this order with a copy marked to the 2nd respondent. 5.With the above direction, this writ petition is disposed of. No costs.
