This Petition is filed to condone the delay of 43 days in filing the above Civil Miscellaneous Appeal as against the order made in M.C.O.P.No.510 of 2020, dated 10.1.2025 on the file of the Motor Accidents Claims Tribunal/Special District Judge, Thanjavur.

2.Heard the learned counsel appearing for the Petitioner and fifth respondent and perused the materials placed before this Court. Mr.Shajahan, learned counsel undertakes to file vakalath for R5. R3 name printed in the cause list, called absent and set ex-parte. The learned counsel for the appellant states that R6 to R9, who are the legal heirs of deceased R4 have already been set exparte before the trial Court. Steps not required for them and their appearance may be dispensed with. The said memo is recorded and their appearance is dispensed with as per the above memo. 3.For the reasons stated in the accompanying affidavit filed in support of the Petition and on being satisfied with the same, this Petition is allowed and the delay is condoned.
