ORDER : The Court Made the following order :- The petitioner/Accused apprehends arrest at the hands of the respondent police for the offences punishable under Section 506(ii) of I.P.C. in Crime No.not known of 2018, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner filed suits in O.S.No.85 of 2010 and 204 of 2010 to attach the immovable properties of one Muthukumaran. While so, one Janakiraman, who is the brother of the said Muthukumaran lodged a complaint before the respondent police.

3.When the matter was taken up for hearing on 24.09.2018, the learned government Advocate (criminal side) would submit that petition enquiry pending and hence, the matter was posted today for reporting compliance. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that the enquiry has been conducted and a case in crime No.211 of 2018 has been registered as against the petitioner for the offence under Section 341, 294(b) and 506(i) of I.P.C. and the investigation is going on.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

4.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.V, Madurai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 5..The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
