Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 2nd Respondent herein to survey the petitioner's property and fix the boundaries and subdivide the same comprised in Resurvey No.76/1 to an extent 2 Acres 78 cents of Kaliyal Village, Vilavancode Taluk Kanyakumari District with the help of a qualified Taluk Surveyor as per the Resurvey plan and revenue records.

ORDER

The Petitioner seeks for a direction to the second respondent to survey the petitioner's property and fix the boundaries and subdivide the same comprised in Resurvey No.76/1 to an extent 2 Acres 78 cents of Kaliyal Village, Vilavancode Taluk Kanyakumari District. To that effect, the petitioner has already made a representation before the second respondent on 14.11.2016. 2.By consent of both parties, the main Writ Petition is taken up for disposal, at the admission stage itself. https://hcservices.ecourts.gov.in/hcservices/

3.In view of the above, it is for the second respondent to consider and pass orders on such representation on merits and in accordance with law and after hearing the rival claimants, if any. 4.Therefore, without expressing any view on the merits of the claim made by the Petitioner, I only direct the second respondent to consider the representation of the Petitioner, dated 14.11.2016 and pass orders on the same, on merits and in accordance with law, also by hearing other rival parties, if any, within a period of twelve weeks from the date of receipt of a copy of this order. 5.With the above direction, the Writ Petition is disposed of. No costs.
