ORDER

This writ petition has been filed seeking a direction to the respondent to provide the copies of the documents (i) The Charge memo, its explanation and the one man committee report of one Prof.Dr.Uma (Former COE) pertaining to the very same allegation; (ii) The Charge Memo, its explanation and the one man committee report of one Dr.Srinivasan pertaining to the very same allegation; and (iii) Minutes of the Syndicate meeting pertaining to the allegation, to the petitioner by considering the representation of the petitioner dated 03.06.2025 within the time frame stipulated by this Court.

2. By consent of both parties, this writ petition is disposed at the stage of admission itself.

The petitioner joined as Professor in the respondent University in the year 2010 and she was elevated to the post of Dean, also placed as Zonal Coordinator and conferred with the post of Deputy Director of Affiliation. While this being so, the petitioner was called for enquiry about the irregularities taken place in the examination held during April - May 2016, 2/6

through communication dated 08.05.2018. However, the documents relating to the said irregularities have not been given. Hence, the petitioner made a representation to the respondent dated 03.06.2025. Since the said representation was not considered, the petitioner has filed the present Writ Petition.

It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, nonconsideration of the representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of India and direct them to consider the same within a stipulated time.

In the light of the above observations, there shall be a direction to the respondent to consider the petitioner's representation dated 03.06.2025, on its own merits and pass appropriate orders in accordance with law, within a period of one week from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to 3/6

the merits of the matter and that it is open to the respondent to consider the same on its own merits.

6. With the above observations and directions, the Writ Petition stands disposed of. There shall be no order as to costs. 16.06.2025 NCC : Yes/No Index : Yes / No sm 4/6
