Heard Mr. R. Murali, learned counsel for the petitioner, and Mr. M. Viji, learned counsel appearing for the respondents. 2.The petitioner has approached this Court seeking issuance of a Writ of Mandamus directing the respondents to assess the current consumption charges in respect of the petitioner's Electricity Service Connection No.05-109-008-2124 under Tariff III-B for the period from 29.04.2017 to 10.08.2017.
3.The case of the petitioner is that the electricity service connection was sanctioned for operating a cold storage unit and, therefore, Tariff III-B is applicable for the assessment of current consumption charges. However, the second respondent assessed the current consumption charges by treating the premises as a commercial establishment.

3.It is the further case of the petitioner that this Court, in W.P.(MD) No.5970 of 2024, recorded the submission of the learned Standing Counsel appearing for the respondents that, upon the petitioner submitting an online application along with all relevant particulars, the service connection would be assessed under Tariff III-B. Recording the said submission, this Court disposed of the writ petition by order dated 12.03.2024.
4.Pursuant to the aforesaid order, the second respondent assessed the current consumption charges under Tariff III-B for the period from September 2017 till date. However, the electricity service connection had been sanctioned in March 2017. Therefore, the second respondent ought to have assessed the current consumption charges under Tariff III-B for the period from 29.04.2017 to 10.08.2017 as well. 5.In view of the above, the writ petition is allowed and the second respondent is directed to assess the current consumption charges in respect of the petitioner's Electricity Service Connection No. 3/5
05-109-008-2124 under Tariff III-B for the period from 29.04.2017 to 10.08.2017.
6.The aforesaid exercise shall be completed within a period of four
(4) weeks from the date of receipt of a copy of this order. 7.There shall be no order as to costs.
