For Respondent : Mr.E.Antony Sahaya Prabhakar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.557 of 2020 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 457 and 380 of IPC, in Crime No.557 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with others broke open the TASMAC shop and taken away 385 liquor bottles worth about Rs.1,50,000/- from the shop. On the complaint of the District Supervisor of TASMAC, the case has been registered against the petitioner.

3. This petitioner and one Jayapal moved an application for anticipatory bail before this Court in Crl.O.P(MD)No.11758 of 2020 and also offered to deposit a sum of Rs.50,000/-.

4. Considering the said submission of the learned counsel for the petitioners, this Court by order dated 02.11.2020 granted anticipatory bail with a condition that the petitioner shall deposit a sum of Rs.50,000/-. The petitioner having availed an order of anticipatory bail on the pretext that he will deposit a sum of https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD).No.13390 of 2021 Rs.50,000/-, has not paid the said amount and has not surrendered before the Court so-far.

5. Considering the conduct of the petitioner that he has availed the order from this Court that he will deposit a sum of Rs.50,000/- and has not paid the amount and has not surrendered before the Court for the past 1 1⁄2 years and evading the arrest and that this petitioner is having two previous cases of similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.
