ORDER

This transfer petition is filed by the petitioner/wife seeking transfer of H.M.O.P.No.102 of 2021 filed by the respondent/husband for dissolving the marriage between him and the petitioner herein from the file of the learned Sub Court, Sivakasi to the file of the Sub Court, Tirunelveli.

2.The petitioner is residing at Tirunelveli and has a one year old child. The petitioner would contend that she had to move her matrimonial home on account of the mental and physical torture that she suffered at the hands of the respondent. She would submit that to date, the respondent has not supported her or her son financially. She would further submit that if she has to attend the case at Sivakasi, she will have to travel a distance of not less than 105 kms and her small baby is still dependent on her for his feeding.

Tr.C.M.P.(MD) No.364 of 2021 3.Considering the above, this Transfer Civil Miscellaneous Petition is allowed and the petition in H.M.O.P.No.102 of 2021, filed by the respondent/husband, is withdrawn from the file of the learned Sub Court, Sivakasi, and transferred to the file of the learned Sub Court, Tirunelveli. No costs. Consequently, connected miscellaneous petition is closed.
