This Transfer CMP has been filed by the petitioner / wife seeking transfer of HMOP.No.69 of 2019, on the file of the Sub Court, Virudhunagar to Family Court, Chennai.

2. Both sides counsel would submit that pending transfer petition, the parties have decided to part ways permanently and they have filed a petition under Section 13(B) of the Hindu Marriage Act, seeking divorce by mutual consent. In view of the same, the prayer sought for in the Transfer CMP has become infructuous.

Recording the submission made by the learned counsel on either side, proceeding in HMOP.No. 69 of 2019 is withdrawn from the file of the Sub Court, Virudhunagar and dismissed as infructuous and as a consequence, the Transfer CMP is also dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed.
