ORDER
The respondent police registered a case as against this petitioner in Crime No.4 of 2024 for the offence under Sections 8(c), 22(c), 25, 29(1) of NDPS Act and remanded him into judicial custody on 29.02.2024. Therefore, the petitioner has filed this petition seeking bail.
2.The case of the prosecution is that the petitioner and other accused were found in
illegal possession of the following contraband:- 1.Amphetamine - 250 gram 2.Pseduo Ephedrine - 150 gram 3.White lump like Glucose - 300 gram 4.White stick whith crystal shape - 850 gram 5.White Powder with a slight brownish tint - 4.750 kgs. 6.White Powder with a glaze - 8 kgs 7.White Urea-like powder - 10.500kg 8.Brown color powder - 0.900 gram 9.Pink color Tablet - 72 (Nos) 10.Five Liter Plastic can containing acetone liquit - One No. 11.Sodium Hydrozide Pellets Extra pure can - 2.300 kgs 12.Brown color glass bottle - 1 No 3.The contention of the petitioner is that based on confession of the co-accused, the petitioner was implicated as A3.
4.The learned Additional Public Prosecutor appearing for the respondent submitted
that the petitioner was arrayed at based on confession. However, CDR particulars are against the petitioner. The petitioner was having more than three SIM cards and 71 calls were made to the 2nd accused and 220 calls were made to the 4th accused. Further, the tower location of the petitioner's mobile was matching the location. Therefore, the petitioner's confession plea is rejected. 5.The next contention of the petitioner is that already, A5 and A6 were granted bail. But the learned Additional Public Prosecutor submitted that A7 was also granted bail, but he is under NBW. Totally there are 7 accused. The trial has started and the next date of hearing is 13.02.2026. If bail is granted, the accused will not conduct the case and the trial will not proceed further.
Therefore, the learned Additional Public Prosecutor vehemently objected for granting bail. 6.Further, it is seen that this is the fourth bail application and the third bail application was dismissed after the chargesheet was filed. There is no change in circumstances. Therefore, the present criminal original petition cannot be considered. 7.The learned Counsel appearing for the petitioner submitted that he was doing fish business but no materials were submitted before this Court to consider the same. 8.
