ORDER : The Court made the following order :- The petitioner/A2 apprehending arrest at the hands of the respondent police for the offence under Section 379 IPC @ 21(1) of Mines and Minerals (Development and Regulation) Act, in Crime No.76 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused have illegally transported two units of gravel by using Lorry. Therefore, the present case came to be registered. 3.The learned counsel for the petitioner submits that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution, but he has been falsely implicated in this case.

CRL OP(MD). No.12824 of 2021 4.The learned Government Advocate (Crl. Side) for the respondent police, on instructions, submits that apart from this case, the petitioner has involved in two previous cases in Crime No.753 of 2009 for the offence under Sections 397, 506(2) IPC @ 41

(2) Cr.P.C., 397 and 506(2) IPC and Crime No.565 of 2019 for the offence under Sections 147, 294(b), 323, 379, 448 and 506(2) IPC and Section 4 of TNPHW Act.

5.Considering the nature of offence and the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this Criminal Original Petition stands dismissed.
