Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the records relating to impugned order dated 17.02.2017 of respondent herein and quash the same and consequently direct the respondent herein to grant permission to conduct the cultural program namely Adalum Padalum on 04.03.2017 during Arulmigu Vailu Muthamman Thirukovil Festival. For Petitioner : Mr.T.Pon Ramkumar For Respondent : Mr.D.Muruganantham, Additional Government Pleader.

ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to call for records relating to the order dated 17.02.2017 passed by the respondent and quash the same and also for directing the respondent to give permission for conducting Adalpadal Programme in the place mentioned in the petition, by way of issuing a writ of certiorarified mandamus. 2.Mr.D.Muruganandam, learned Additional Government Pleader, has taken notice for the respondent.

3.It is seen from the records that the representation of the petitioner has been rejected mainly on the ground that Police Act 30(2) is in force.

4.Considering the representation given on the side of the petitioner and also considering the reason given by the respondent for rejecting permission, this Court is of the view that the https://hcservices.ecourts.gov.in/hcservices/

respondent has not assigned proper reason for rejecting the representation given by the petitioner and therefore the same is liable to be quashed.

5.In fine, this writ petition is allowed in part without costs and the impugned order dated 17.02.2017 passed by the respondent is quashed. The respondent is directed to consider the representation alleged to have been given by the petitioner and dispose of the same within a period of two days.
