PRAYER: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to conclude the disciplinary proceedings pending against the petitioner within a reasonable time as may be specified by this Court. ORDER

This writ petition has been filed to direct the respondent to conclude the disciplinary proceedings pending against the petitioner.

2.Mr.D.Shanmugaraja Sethupathi, learned Standing Counsel takes notice for the respondent. By consent of both parties, the writ petition is taken up for disposal at the admission stage itself. 3.According to the petitioner, his date of superannuation fell on 28.02.2015 and he was placed under suspension on 16.02.2015 ie., 12 days prior to his retirement. After that, the respondent by order dated 12.11.2018, appointed an Enquiry Officer to conduct the enquiry. After receiving the enquiry report, the respondent issued a show cause notice to the petitioner on 26.12.2018. On such show cause notice, the petitioner submitted his explanation on 03.01.2019. However, no further action is taken so far till date and the disciplinary proceedings pending against the petitioner is not yet concluded. Hence, the petitioner is before this Court for https://hcservices.ecourts.gov.in/hcservices/

the relief stated supra.

4.The learned Standing Counsel appearing for the respondent would submit that the disciplinary proceedings pending against the petitioner will be concluded by the respondent within a time frame to be fixed by this Court.

5.Recording the said submission made by the learned Standing Counsel appearing for the respondent, without expressing any opinion on the merits of the claim made by the petitioner, this Court directs the respondent to conclude the departmental disciplinary proceedings pending against the petitioner and take a decision within a period of three months from the date of receipt of a copy of this order.

6.With the above direction, this Writ Petition is disposed of. No costs.
