ORDER

This petition is filed to relax the condition which was imposed on the petitioner in Crl.M.P.(MD)No.3506 of 2025 in Crl.A.(MD)No.685 of 2024, dated 17.03.2025.

2. In view of the extraneous circumstances involved in this case, it has been ordered to the respondent-police to know about the present condition of the victim, because the petitioner has stated that the victim girl has become major and she had married someone else and settled as a family.

3. When the matter was taken up for hearing today i.e., 24.06.2025, the learned Government Advocate (Crl.side) appearing for the State, on instructions, would submit that it is not possible to enquire with the victim, as her whereabouts are unknown, despite the fact that she had married another person.

4. However, the mother of the victim, who is the defacto complainant, is present before this Court and has stated that the victim married another person of her own choice and her daughter does not have any contact with her. It appears that even the defacto complainant does not have much interest in pursuing the case and it is doubtful whether the victim will be traceable in the near future. In such case, there is no necessity to insist that the petitioner, who remand at Chennai, should continue to remain in custody and abide the condition imposed by this Court.

5. The learned counsel for the petitioner submits that the petitioner is a daily wager and prayed to modify the condition imposed by this Court by allowing the 2/4

petitioner to reside at Sivagangai, thereby enabling him to pursue his livelihood.

6. Considering the change of circumstances and the facts reveals before the Court, I feel it is appropriate to modify the condition imposed on the petitioner to a certain extent.

7. Accordingly, the condition already imposed on the petitioner is hereby modified and the petitioner shall appear and sign before the Sivagangai Town Police Station, on the first working day of every English Calendar month, till the disposal of the appeal.
