ORDER

This criminal original petition has been filed seeking a direction to the second respondent not to interfere with the money dispute between the petitioner and the third respondent and not to harass the petitioner in the name of enquiry based on the complaint given by the third respondent by considering the petitioner's representation dated 30.04.2026.

2.The learned counsel appearing for the petitioner submits that the petitioner borrowed a hand loan of Rs.8,00,000/- from the third respondent on 18.02.2025 with interest of 5% per month. At that time, he gave a blank cheque No.598174 to the third respondent for security purpose. After that, the petitioner repaid the principal amount and requested to return the said cheque. In this situation, the third respondent sent a legal notice with false allegation. On 29.04.2026, on the 2/5

instigation of the third respondent, the second respondent police went to the petitioner's home and threatened to register a false case against the petitioner and harassed the petitiioner under the guise of enquiry. Hence, the defacto complainant filed this criminal original petition. 3.The learned Government Advocate (crl.side) appearing for the respondent police submits that on the complaint given by the third respondent against the petitioner, petition enquiry is pending on the file of the respondent police.

4.Heard the learned Counsel for the petitioner and learned Government Advocate (Crl.side) for the respondent police. 5.It is the grievance of the petitioner that the respondent police has been harassing her under the guise of an enquiry/investigation and hence, has invoked the inherent powers of this Court under Section 482 of Cr.P.C.

In this view of the matter, the second respondent is directed to consider the representation of the petitioner and pass orders in accordance with law and follow the guidelines stipulated for preliminary enquiry or registration of FIR by the Hon'ble Supreme Court in Lalita Kumari Vs. Government of Uttar Pradesh and others [2014 (2) SCC (1)].

7.With the above direction, the Criminal Original Petition stands disposed of.
