ORDER

The petitioner seeks for a mandamus directing the 1st respondent to grant educational loan for the studies of the son of the petitioner, namely S.Rajiv, on the basis of the representation sent by the petitioner, dated 30.01.2017.

2.On notice, the respondent Bank is being represented by the Standing Counsel.

3.The learned Standing Counsel, based on instructions from the Bank submitted that the petitioner is seeking educational loan of Rs.7 lakhs and however, when the Bank insisted for production of security, as the loan amount exceeds Rs.4 lakhs, the petitioner is not willing to furnish the same. Therefore, he submitted that the request of the petitioner has not been considered.

4.The learned counsel appearing for the petitioner submitted that the petitioner would furnish property security for availing the loan and as and when the petitioner furnishes such https://hcservices.ecourts.gov.in/hcservices/

security, the respondent Bank may be directed to consider the said request of the petitioner.

5.The learned counsel for the respondent Bank submitted that if the petitioner furnishes the security for availing the loan, certainly, the respondent Bank would consider the application for grant of educational loan, as per the norms and guidelines prescribed by the Reserve Bank of India. 6.Considering the above facts and circumstances of the case and the submissions made by both sides , this writ petition is disposed of by directing the petitioner to furnish security to the respondent Bank for availing the educational loan and if the petitioner furnishes the security, it is for the respondent Bank to consider the request of the petitioner and pass orders within a period of four weeks from the date of receipt of such security. No costs.
