PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to restrain the fourth respondent from the transfer of sale and ownership of the Sree Alagar Agencies, situated at Thirunagar 5th stop, Tirupurankundram Taluk, Madurai to any other persons by considering the petitioner's representation dated 14.06.2023 in accordance with law within the time stipulated by this Court. ORDER

This Writ Petition is filed seeking a direction to the respondents 1 to 3 to restrain the fourth respondent from transferring the sale and ownership of Sree Alagar Agencies, situated at Thirunagar 5th Stop, Tirupurankundram Taluk, Madurai, to any other person, by considering the petitioner's representation dated 14.06.2023 in accordance with law, within the time frame to be stipulated by this Court.

2. The nature of the prayer sought in the present Writ Petition involves disputed questions of fact and is civil in nature. Therefore, these issues cannot be directed to be restrained by the respondents 1 to 3, as the rights of private parties cannot be decided by this Court. Such matters fall exclusively within the jurisdiction of a Civil Court.

3. In view of the same, this Court is not inclined to entertain the Writ Petition. It is open to the petitioner to approach the Civil Court and agitate his rights in accordance with law.

4. With the above observation, this Writ Petition is disposed of. There shall be no order as to costs.
