The Petitioner herein seeks a direction to the second respondent to dispose of the appeal filed by her under Section 12 of the Tamil Nadu Patta Passbook Act on 19.4.2023. 2.Heard the learned counsel for the Petitioner and the learned Government Advocate appearing for the respondents 1 to
4. Though notice was served to the fifth respondent and his name appears in the cause-list, there is no appearance on behalf of him. 3.The Petitioner filed an appeal before the second respondent seeking cancellation of patta issued in favour of fifth respondent in respect of the property in S.No.337/15 situated in Manalmelgudi Village, Dindigul District. Though the appeal was 2/5
presented on 19.4.2023, the same has not been disposed of so far. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra.
4.Mr.M.Gangatharan, learned Government Advocate who appears for the respondents 1 to 4 would submit that the appeal filed by the Petitioner will be considered on its own merits within the time stipulated by this Court.
5.In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to dispose of the appeal filed by the Petitioner, dated 19.04.2023 and pass final orders on its own merits after issuing notice to the Petitioner and fifth respondent, within a period of 12 weeks from the date of a copy of this order.
6.With the above directions, the Writ Petition stands disposed of. No costs.
