PRAYER: Habeas Corpus Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, to direct the respondent Nos.1 and 3 for produce the person or body of the detenu by name R.Sarumathi, D/o.Raja, aged about 21 years before this Hon`ble Court and set her at liberty. ORDER
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) Alleging that the petitioner's daughter viz., R.Sarumathi, aged about 21 years, was found missing from 16.03.2025 and that despite complaint has been registered on17.03.2025 in Crime No.63 of 2025 for "Woman Missing", the respondent has not taken any action. Hence, the present Habeas Corpus Petition is filed.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. 3.When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondents, on instructions, would submit
that based on the complaint given by the petitioner, a case in Crime No.63 of 2025 was registered for 'Woman Missing' and during the course of investigation, the alleged missing person Sarumathi, aged about 21 years was traced and on enquiry, she submitted that she had married one Palanimurugan, with whom she was in love for some time, while she was studying Homeopathy Medicine in Trichencode and that they have got married on 05.04.2025. The learned Additional Public Prosecutor would further submit that the said information was also given to the petitioner who had also appeared for enquiry and he has refused to give any statement. The learned Additional Public Prosecutor would further submit that the respondent police dropped the action with regard to the complaint given by the petitioner.
4.We are of the view that since the detenue is a major, she is entitled to take her own decision and that there is no illegal custody. Hence, the Habeas Corpus Petition stands closed.
