PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorari, to call for the records pertaining to the impugned order dated 03.04.2023 in Na.Ka.No.187/A1/2023 passed by the 1st respondent and to quash the same in so far as prohibition order of injunction 1/5

restraining the 3rd respondent from registering any document based on Doc.No. 152/2008 on the file of the 3rd respondent.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash theimpugned order dated 03.04.2023 in Na.Ka.No. 187/A1/2023 passed by the 1st respondent in so far as prohibition order of injunction restraining the 3rd respondent from registering any document based on Doc.No.152/2008 on the file of the 3rd respondent. 2.The writ petitioner had purchased the Plot No.23 Document No. 1529 of 2011. However, while the 2nd respondent was considering the same, an allegation was placed by the 4th respondent and four others. Therefore, the impugned order came to be passed, whereby, the petitioner's document number was also included.

3.However, the impugned order was passed without hearing the 2/5

petitioner. Therefore, the second respondent shall consider the petitioner's case especially as far as Plot No.23 in Document No.1529 of 2011 is concerned and delete the said entry. The official respondents shall pass an order stating that the impugned order is not applicable to Plot No.23 in Document No.1529 of 2011. However, it is made clear that the impugned order is a protection order given to the 4th respondent and the same shall not be disturbed. 4.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed .
