ORDER

The petitioner has approached this Court seeking a direction to the respondent to complete the investigation in Crime No.550 of 2023 and to file the final report, within a time frame.

2.The learned Government Advocate(Crl.side) appearing for the respondent submits that they have completed investigation and found that there is no materials to proceed with the complaint and therefore, closed the case as mistake of fact on 28.11.2023. However, the closure report was presented before the learned Judicial Magistrate, Thirumangalam only on 04.07.2024.

3.Since it is reported that the case has been closed as mistake of fact, the respondent Police is directed to serve a copy of the closure report along with RCS notice to the petitioner, within a period of two weeks from the date of receipt of a copy of this order. The petitioner is at liberty to file a protest petition before the learned Judicial Magistrate, Thirumangalam, if so advised. Accordingly, this criminal original petition is disposed of.
