RESPONDENT/ PETITIONER/ PETITIONER Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to permit the petitioner to withdraw amount of Rs.2,00,000/-(Rupees Two Lakhs Only) deposited in C.C.NO.40 of 2012 before the Learned Judicial Magistrate (Fast Track Court) Karaikudi as per order of this Honourable Court in Crl.M.P.(MD) NO.584 of 2017 in Crl.R.C.(MD) NO.54 of 2017 dated 12/02/2018 and thus render justice.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mrs.P.KALAIYARASI BHARATHI, Advocate for the petitioner and of Mr.TAMILMANI, Advocate on behalf of the Respondent, the court made the following order:- Pursuant to the direction passed by this Court while granting suspension of sentence, the revision petitioner has deposited Rs.2,00,000/-. Now the respondent has taken out an application to withdraw the said amount. The request made in the petition in Crl.M.P.(MD)No. of 2018 cannot be acceded, since the very liability is questioned by the appellant herein. If the application is allowed, then it may cause adverse effect in the appeal itself. Hence, this petition is dismissed.
