ORDER

This criminal original petition has been filed seeking for a direction to direct the respondents No.1 to 4 not to harass the Petitioner and his family members in guise of any enquiry without any complaints or summons or reasons against the Petitioner and failed to follow the D.K.Basu Guidelines issued by the Hon'ble Apex Court by the same respondents.

2. The facts of the case are that a case has been registered in Crime No. 552 of 2021 for offences under Section 302 I.P.C. against the petitioner based on the confession statement of some other accused. However, the petitioner obtained bail from the said prosecution. In such circumstances, the respondent Police repeatedly harassing the petitioner and his family members without following the procedure. Having no other way, the petitioner filed the present Criminal Original Petition.

3. The learned Government Advocate (Criminal Side) appearing for the respondent Police submitted that the petitioner is an accused in murder case in Crime No.552 of 2021 for offences under Section 302 I.P.C and the respondent Police have not harassed the petitioner, they only make surveillance of the presence of the petitioner.

4. The learned counsel for the petitioner submitted that admittedly, there was a murder case against the petitioner and he was on bail and he is not involved in any offences.
