O R D E R

This petition has been filed to direct the respondents 1 and 2 not to harass the petitioners on the false complaint of the third respondent.

2.There was a dispute with regard to business transaction between the petitioners and the third respondent. Hence, the third respondent lodged a complaint before the respondent police. Based on the complaint, the respondent police continuously harassing the petitioners under the guise of enquiry. Hence, the petitioners are before this Court.

3.The learned Additional Public Prosecutor, appearing for the respondents 1 and 2 would submit that based on the complaint, enquiry has been initiated in CSR.No.620 of 2020, dated 10.11.2020 and it is pending.

C rl.O.P.(MD)No.12828 of 2020 4.Considering the facts and circumstances of the case, this Criminal Original Petition is disposed of with a direction to the respondents 1 and 2 to follow the principles laid down by the Hon'ble Apex Court in D.K.Basu Vs. State of West Bengal reported in AIR (1997) SC 610 while enquiring the petitioners. If at the end of the enquiry, it is decided to register any FIR, the petitioners shall be put on notice so that the petitioners will have breathing time to move the concerned Court for appropriate remedy.
