Respondent PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to consider the representation dated 21.12.2015, requesting the respondent to access the property tax for the built up area 34,828 sq.ft. and not for 44,216 sq.ft. in respect of the petitioners' building bearing Door No.54/7 Nataraja Nagar, Melakkal Road, Kochadai, Madurai, within a time limit fixed by this Court.

O R D E R

The petitioners seek for a mandamus, directing the respondent to consider the representation dated 21.12.2015 to assess the property tax for the building bearing door No.54 / 7 measuring an extent of 34,828 sq.ft. instead of 44,216 sq.ft. at Nataraja Nagar, Melakkal Road, Kochadai, Madurai.

2.Perusal of the facts and circumstances of the case as disclosed in the affidavit as well as in the typed set of papers would show that already the subject matter of the property was assessed by the Madurai Corporation and a demand notice dated 04.12.2015 was also issued to the petitioners through assessment No.384639 for the period commencing from 01.04.2011. Therefore, already when the property is assessed, there is no question of assessing the property once again as sought for by the petitioners through their representation.

Therefore, the very representation itself is misconceived and consequently, the filing of the Writ petition with the above said prayer is also misconceived. https://hcservices.ecourts.gov.in/hcservices/ 3.Accordingly, this Writ petition is dismissed with liberty to the petitioners agitate as against the order of such assessment in the manner

known to law before the appropriate forum. No costs. Consequently, connected W.M.P.is closed.
