Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. 2.This Criminal Original Petition has been filed to transfer the investigation in Crime No. 925 of 2020 dated 23.08.2020 from the 4th respondent police to the 5th respondent CBCID. 1/3
3. The learned counsel for the petitioner would submit that a case in Crime No.925 of 2020 has been registered under Section 302 of IPC against unknown accused on 25.08.2020. But, so far no accused has been fixed in this case. Also, relevant penal provisions of Scheduled Case and Scheduled Tribe (Prevention of Atrocities) Act, 1989 also to be added. The learned counsel further submits that the fourth respondent is not interested to conduct the investigation in fair and transparent manner. Hence, this petition. 4.Today when the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that two persons namely Kannan & Manikandan has been fixed as accused in this case. Final Report dated 04.11.2020 has also been made ready. Moreover, alongwith Section 302 of IPC, Section 3(2)(v) of Scheduled Case and Scheduled Tribe (Prevention of Atrocities) Act, 1989 has also been included in the Final Report. Copy of the Final Report also been produced before this Court.
5.In view of the subsequent developments, the respondent is directed to file the Final Report within a period of two weeks from the date of receipt of a copy of this order.
6. With the above direction, this Criminal Original Petition is disposed of. Consequently, connected Miscellaneous Petition is closed.
