Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of Mandamus directing the 2nd respondent to cancel the patta which is in the name of the 3rd respondent with regard to the land in Dindigul District, Dindigul West Taluk, Palakkanoothu Village, Natham in S.F.No. 1252/10 based on the petitioner's representations dated 19.08.2015 and 07.06.2016.

The petitioner seeks for a direction to the 2nd respondent to cancel the patta standing in the name of the third respondent, based on his representation, dated 19.08.2015. https://hcservices.ecourts.gov.in/hcservices/ 2.Heard the learned counsel appearing for the petitioner as well as the learned counsel appearing for the respondents.

3.It is appears that the petitioner has made a petition before the second respondent for cancellation of patta standing in the name of the third respondent. Therefore, it is for the second respondent to consider the request of the petitioner and pass orders on the same on merits and in accordance with law, after hearing the third respondent as well. Therefore, without expressing any view on the merits and contention raised in this writ petition, I only direct the second respondent to dispose of the petitioner's representations, dated 19.08.2015 and 07.06.2016 by passing an order on the same on merits and in accordance with law, after hearing both sides. The said exercise shall be done by the second respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
