Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of mandamus, directing R1 and R2 to grant police protection to construct compound wall surrounding the petitioner's property situated in Plot Nos.15, 16, 27 and 28 measuring an extent of 18.07 cents (735.83 sq meters) situated at Pudhupalayam Village, Rajapalayam Taluk, Virudhunagar District as per the representation given by the petitioner dated 30.04.2026.

ORDER

The present Writ Petition is filed for a Writ of mandamus, directing R1 and R2 to grant police protection to construct compound wall surrounding the petitioner's property situated in Plot Nos.15, 16, 27 and 28 measuring an extent of 18.07 cents (735.83 sq meters) situated at Pudhupalayam Village, Rajapalayam Taluk, Virudhunagar District as per the representation given by the petitioner dated 30.04.2026.

2. Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Crl. Side) takes notice for the respondents.

3. By consent on either sides, this Writ Petition is taken up for final disposal at the admission stage itself.

4. The learned counsel appearing for the petitioner submitted that the petitioner is the lawful owner of the above subject properties. The revenue records have been mutated in the name of the petitioner. Since joint patta was issued, the joint pattadharar and the neighbours are objecting for construction of compound wall around the petitioner's properties. According 2/5

to him, after purchase of the subject properties, the properties were surveyed by the concerned Tahsildhar, demarcated and survey stones have also been laid. Hence, the petitioner has come up with the present petition.

5. The learned Government Advocate (Crl. Side) appearing for the respondents submitted that it is difficult for the police officials to identify the exact boundary of the petitioner's land.

6. According to the petitioner, the subject properties were surveyed by the concerned Tahsildhar, demarcated and survey stones have also been laid. In such circumstances, this Court directs the second respondent to provide necessary police protection to the petitioner for construction of compound wall, if survey stones as contended by the petitioner are available. If such survey stones are not available, the petitioner has to approach the concerned Tahsildhar for surveying, demarcation and laying of survey stones and once survey stones are laid, the petitioner shall approach the second respondent police for police protection. The police protection shall be granted at the cost of the petitioner.

7. With the above directions, this Writ Petition is disposed of. No costs.
