Prayer : Criminal Original Petition filed under Section 528 of BNSS, to call for records in CC No.609 of 2024, on the file of the Judicial Magistrate Court No.VI, Trichy and quash the same as devoid of merits as against the petitioner.

O R D E R

The petitioner has approached this Court to quash the proceedings in CC No.609 of 2024, on the file of the Judicial Magistrate Court No.VI, Trichy.

2.The case of the prosecution is that the petitioner was in possession of forged travel documents and therefore a case in Crime No. 197 of 2004, dated 24.06.2004, for the offence under Sections 468, 467 r/w 471 IPC and 12(1)(a) of Indian Passport Act, 1967 was registered. 3.The learned counsel for the petitioner submits that without proper investigation, the respondent police has filed the final report in the year 2024 for the alleged incident said to have taken place in the year 2004 and now the case is pending before the Judicial Magistrate Court No.VI, Trichirappalli in CC No.609 of 2024 and therefore, the above proceedings has to be quashed as against this petitioner. 4.Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Crl.side) who takes notice for the first respondent strongly objects for 2/5

quashing the proceedings in CC No. 609 of 2024 that the petitioner was in possession of two copies of same visa with same entry permit number, for two different professions. He further submits that his involvement in the commission of offence has been substantiated by the prosecution. 5.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent.

6.Though the petitioner has raised several grounds, this Court is of the opinion that it can be appreciated only during the trial. Therefore, this Court is not inclined to entertain this petition at this stage and accordingly, this Criminal Original Petition is dismissed. However, liberty is granted to the petitioner to raise all these grounds before the trial Court, during trial. Consequently, connected miscellaneous petitions are closed.
