This Writ Petition has been filed seeking a writ of mandamus directing the respondents to settle the petitioner's surrender leave salary of Rs.4,03,900/- for 180 days together with interest at the rate of 6 percent per annum payable from the date of his retirement to till the date of actual payment.
2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The petitioner was appointed as a Tradesman in the respondent Corporation on 19.06.1998 and he retired from service on 31.05.2023. The learned counsel for the petitioner submits that the petitioner's terminal benefits was not settled immediately and there is an abnormal delay.
4. In view of the same, the only issue to be considered in this Writ Petition is with regard to interest payable on the belated settlement. This issue was dealt with by this Court on various occasions and this 2/8
Court passed orders in several Writ Petitions. In fact, the issue involved in this writ petition is no longer res-integra.
5. This Court in W.P(MD)No.4866 of 2023 (C.MuruganVs. the Tamil Nadu State Transport Corporation (Tirunelveli) Ltd., and Another) by order dated 07.03.2023 has decided this issue.
6. Accordingly, by following the order stated supra, this Writ Petition is allowed with the following direction: The respondent shall pay interest to the petitioner at the rate of 6% per annum on the belated payment of the retirement benefits commencing from the date of retirement, till date of actual disbursement, within a period of three months from the date of receipt of a copy of this order. No costs.

This Writ Petition is listed today under the caption ''for being mentioned'' at the instance of the learned counsel for the petitioner.
2. The learned counsel for the petitioner submits that Paragraphs 3 to 6 of the order dated 17.06.2025, passed in W.P.(MD)No. 15797 of 2025, which relate to interest payable on the belated settlement, have been erroneously included. Therefore, the learned counsel prays for necessary correction in the said order.
3. In view of the above, the Registry is directed to carry out the corrections by substituting the following Paragraphs in the place of Paragraphs 3 to 6 of the order dated 17.06.2025 and to issue a fresh copy of the corrected order forthwith.
3. A perusal of the records reveal that the petitioner had attained superannuation on 31.05.2023. However, his surrender leave salary was not paid, due to paucity of fund. The petitioner has sent a representation on 05.04.2025, seeking the above said 6/8
benefits. Since there is no response from the authorities so far, the present writ petition has been filed.
4. Considering the above said facts, the respondents herein are directed to disburse the eligible surrender leave salary of the writ petitioner along with 6% interest from the due date till the date of disbursement within a period of twelve (12) weeks from the date of receipt of a receipt of a copy of this order.
5. With the above said directions, this writ petition stands disposed of. No costs.
