The petitioner/A3, who was arrested and remanded to judicial custody on 18.08.2024 for the offences punishable under Sections 296(b), 121(1), 109, 351(3) of BNS, Section 8(c) r/w.20(b)(ii)(C) of NDPS Act and Section 25 (1B) (b) of Arms Act in Crime No. 377 of 2024 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 22.900kgs of ganja. Hence, the case..

The learned counsel for the petitioner submits that the respondent police has registered a false case against the petitioner and he is not involved in any such activities as alleged by the respondent police. He would further submit that the petitioner has been arrested and remanded to judicial custody on 18.08.2024. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate(Crl.Side) appearing for the respondent would submit that the petitioner along with other accused were 2/5

found in illegal possession of 22.900kgs of ganja which is a commercial quantity. He would further submit that the petitioner has some previous case. Hence, he opposed to grant bail to the petitioner.

5. This Court heard both sides and perused the materials available on record.

6. Considering the rival submissions on either side and that the contraband involved in this case is commercial quantity and also the fact that the petitioner has some previous case and the fact that the petitioner has not satisfied the twin condition as per Section 37 of the NDPS Act this Court is not inclined to grant bail to the petitioner.

7. Hence the petition stands dismissed.
