The petitioner has filed the present writ petition seeking for disposal of the appeal filed by the second respondent before the first respondent arising out the proceedings under the Tamil Nadu Cultivating Tenants Protection Act.

2.Since the writ petition is disposed of without affecting the interest of the second respondent herein, notice to him is dispensed with.

3.The petitioner herein was arrayed as one of the respondents in the above appeal. The grievance of the petitioner is that the said appeal is not disposed of so far and consequently, his interest is very much affected.

4.Needless to say that the first respondent, before whom the said appeal is pending, has to consider the appeal and decide the same on merits and in accordance with law and therefore, this Court, at this stage, is not expressing any view on the merits of the matter.

5.Accordingly, this writ petition is disposed of only by directing the first respondent to dispose of the appeal on merits and in accordance with law, after hearing both parties, within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
