To call for the records and set aside the Judgment and conviction dt.5.12.2022 made in Crl.A.No.18 of 2019 on the file of the Learned Principal District and Sessions Judge, Virudhunagar District at Srivilliputhur by which confirming the judgment and conviction order in C.C.No.70 of 2014 on the file of the learned Judicial Magistrate No.I, Sivakasi, Virudhunagar District, dated 11.01.2019, and acquit the petitioner/accused.

2. The learned counsel for the petitioner and the learned counsel Side) appearing for the respondent are present before this Court.

3. The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this court regularly.

4. Considering the nature and the gravity of offence, the condition imposed by this court in Crl.M.P(MD).No.3583 of 2023 in Crl.R.C(MD)No.254 of 2023 dated 02.03.2023 is modified and the petitioner shall report before the concerned trial Court on the first working day of every English calendar month at 10.30 a.m., until further orders.
