Respondent PRAYER : This Criminal Miscellaneous Petition is filed under Section 528 of BNSS to modify the condition No.(iii) with regard to stay at Thanjavur and report before the Gandharvakottai police station daily at 10.30 a.m., imposed against the petitioner in Crl.M.P(MD)No.4425 of 2025 in Crl.A(MD)No.414 of 2025, dated 17.04.2025, by permitting the petitioner to report before the Trial Court namely the learned Sessions Judge / Special Court for the Exclusive Trial of Cases under POCSO Act Cases, Dindigul on the first working day of each calendar English month.

ORDER

This petition is filed to modify the condition which was imposed on the petitioner in Crl.M.P(MD)No.4425 of 2025 in Crl.A(MD)No.414 of 2025, dated 17.04.2025.

2. The learned Government Advocate (Crl. Side) submitted that the petitioner has been complying with the condition regularly, without any default.

3. Considering the fact that the petitioner is complying the condition regularly and also in view of the reasons cited by the petitioner in the affidavit filed in support of this petition, I feel that the condition imposed on the petitioner can be relaxed.

4. Accordingly, the condition No.7(iii) already imposed on the petitioners in Crl.M.P(MD)No.4425 of 2025 in Crl.A(MD)No.414 of 2025, dated 17.04.2025, is hereby modified as follows:

" The petitioner shall report before the Inspector of Police, Town North Police Station, Dindigul, twice in a month (i.e., on the 1st and 15th of every English 2/4

Calender month) at 10.30 a.m., till the disposal of the appeal. If 1st and 15 day falls on a holiday, the petitioner shall appear before the above said Court on the next working day."

5. Other conditions shall hold good.
